Terms of Use

These terms are the agreement between you and UKGADGETS LTD ("we", "us"), a company registered in England and Wales (number 11571746) at International House, 12 Constance Street, London, E16 2DQ, for your use of the Finick mobile app.

1. Accepting these terms

By downloading, installing or using Finick you agree to these terms. If you do not agree, do not use the app. If you are using Finick for a business, you confirm you have authority to accept these terms on that business's behalf.

2. Eligibility

You must be at least 18 years old to use Finick, and old enough to enter a binding contract where you live. Finick is a professional tool intended for contractors, site managers and trades.

3. What Finick does

Finick records punch list and snagging items on building jobs. You photograph defects, annotate the photos, assign items to subcontractors, share lists by link, and export closeout reports as PDFs. The app is offline-first, so it works without a network connection and syncs the parts that need a network when one is available.

A Finick report is a record, not a certificate. The PDFs and lists Finick produces reflect what you entered into the app. They are not a professional inspection, a warranty, a building control sign-off, a certificate of compliance, or advice of any kind. Whether work meets the contract, the building regulations or any standard remains a judgement for you and the professionals responsible for the project.

4. Free tier

Finick is free to use with limits. The free tier gives you one active job at a time and a total of 12 items. The item allowance is a running total across everything you log, not a fresh 12 per job, so closing a job does not return its items to you; deleting an item does free its slot. It includes photos, the pen markup tool, offline working, a watermarked closeout PDF, and the full data export. There is no time limit, no card required and no trial countdown on the free tier. We may change these limits for new users, and if we reduce them we will not remove access to data you have already created.

5. Finick Pro subscriptions

What Pro includes

Marking an item verified, and the before-and-after pairing that goes with it
Share links for the people you assign work to, with no app or login needed at their end
Every report template, with your branding, a signature line and no watermark
Cloud backup of your jobs

Billing and renewal

Pro is offered as a monthly or an annual subscription, purchased inside the app.
Payment is charged to your Apple App Store or Google Play account when you confirm the purchase.
Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before that period ends. Your account is charged for renewal within 24 hours of the end of the current period.
Prices are set per region by the store and are shown to you in your own currency before you buy. We may change prices, and where a change affects an existing subscription the store will notify you and ask for your consent as its rules require.

Cancelling

Manage or cancel your subscription in your store account settings: Settings → Apple ID → Subscriptions on iOS, or Play Store → Payments and subscriptions on Android. Deleting the app does not cancel a subscription. When a subscription ends, Pro features stop and the free tier limits apply again. Nothing you have already created is deleted. Every job, item and photo stays on your phone, stays editable, and the full data export keeps working. What stops is creating beyond the free limits and using the Pro-only features listed above.

One thing does change for other people. Share links you have already sent are paused, and a subcontractor who opens one is told the list is on hold rather than shown the work. They are paused, not deleted, and they start working again on their own if you resubscribe. If you need a sub to keep working through a gap, send them the closeout PDF instead, which is yours to keep either way.

Refunds

Purchases are handled by Apple and Google, and refunds are governed by their policies. We cannot issue a refund for a store purchase directly. If you are a consumer in the UK or the EEA, your statutory cancellation rights still apply. Contact the store first, and contact us if you need help.

6. Your content and your data

Your jobs, items, photos, notes and reports are yours. We claim no ownership of them. You grant us only the limited permission needed to run the service you asked for, such as storing a share link so a subcontractor can open it, or holding a backup so you can restore it.

You are responsible for keeping your own copies. Finick includes a free export that saves your data as a spreadsheet plus every photo. Use it before you delete anything, change phones, or cancel.

7. Share links

A share link is a long, unguessable web address that opens without a password, so that a subcontractor does not have to install anything. That design has a consequence you need to understand and accept:

Anyone who has the link can open it, including anyone it is forwarded to.
You are responsible for who you send links to and for what those links contain.
You can revoke a link at any time in the app, and revoking takes effect immediately. Every link also expires on its own 30 days after it is created; that period is fixed and cannot be extended.
Do not put anything in an item that you would not be willing for a recipient to see.

8. Acceptable use

You agree not to:

Break the law, infringe anyone's rights, or use Finick to harass or defame anyone
Upload content you do not have the right to upload, or photograph people where you have no proper basis to do so
Reverse engineer, decompile or tamper with the app, or try to defeat its integrity checks
Try to obtain Pro features without paying, or to access another user's data
Use the app to build a competing product, or resell access to it
Overload, probe or disrupt our infrastructure, or use automated means to scrape it

We may suspend or end access for a serious or repeated breach.

9. Our intellectual property

The Finick app, its name, its icon, its design and its underlying software are owned by UKGADGETS LTD and protected by copyright and trade mark law. These terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own business or personal use. Nothing else is granted.

10. Availability

Finick works offline by design, so the core of the app keeps running when the network does not. Features that depend on our servers, such as share links, backup and sign in, may be unavailable during maintenance, outages, or a failure at a provider we depend on. We do not promise uninterrupted availability of those parts.

11. Disclaimers

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law allows. We do not warrant that the app will be error free, that it will meet your requirements, or that data will never be lost.

Nothing in these terms excludes or limits any right you have as a consumer that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue, business, contracts, goodwill or data, arising from your use of Finick. This includes any loss arising from a defect that went unrecorded, an item that was not logged, a report that was inaccurate because of what was entered, or a share link that was forwarded.

Where we are liable, our total liability for all claims in any twelve month period is limited to the greater of the amount you paid us for Finick in that period, or ten pounds sterling.

We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

13. Ending this agreement

You can stop using Finick at any time by deleting the app, and you can erase your data with the delete option in Settings, which removes it from the phone and from our servers. We may suspend or terminate access if you breach these terms, or if we discontinue the app. If we discontinue Finick we will give reasonable notice so you can export your data.

14. App store terms

If you obtained Finick from the Apple App Store, the following applies:

These terms are between you and UKGADGETS LTD only, not with Apple. Apple is not responsible for the app or its content.
Apple has no obligation to provide any maintenance or support for the app.
If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation.
Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, regulatory non-compliance, or consumer protection claims.
Apple is not responsible for the investigation, defence, settlement or discharge of any third-party intellectual property claim relating to the app.
You confirm you are not located in a country subject to a US Government embargo or designated as terrorist supporting, and that you are not on any US Government restricted party list.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you obtained Finick from Google Play, your use is also subject to the Google Play Terms of Service, and Google is not a party to these terms.

15. Changes to these terms

We may update these terms. The date at the top of this page shows when they last changed. If a change is material we will tell you in the app before it takes effect. Continuing to use Finick after a change means you accept the updated terms.

16. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK or in the EEA, you keep the benefit of any mandatory protections of your home country's law, and you may bring proceedings there.

17. General

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our consent. These terms, together with the Privacy Policy, are the whole agreement between us about Finick.
