These Terms of Use ("Terms") govern your use of the Oscillia mobile application ("the App") provided by UKGADGETS LTD ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

Wellness tool, not a medical device. Oscillia is a relaxation, meditation, and focus aid that uses binaural beats, isochronic tones, and ambient soundscapes. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, sleep disorder, or psychological condition. If you have a seizure disorder, are pregnant, wear a pacemaker, or have any other medical condition, consult a qualified healthcare professional before using the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that:

You are at least 13 years of age
You have the legal capacity to enter into these Terms
You agree to comply with all applicable laws and regulations

If you do not agree to these Terms, you must not use the App.

2. Service Description

Oscillia is a binaural beats and brainwave entrainment application that allows you to:

Play science-backed presets across Sleep, Focus, Relax, Create, and Solfeggio categories
Synthesize binaural, isochronic, monaural, and pure tones in real time on your device
Layer up to six ambient sounds through the mixer (rain, ocean, forest, campfire, crystal bowls, and procedural noise)
Build and save custom presets (Pro)
Explore the frequency spectrum interactively (Pro)
Review listening stats and full session history (Pro)

All audio is synthesized or played back locally on your device. Oscillia does not record from your microphone and does not transmit audio to any server.

3. Subscription Terms

Subscription and Purchase Plans

Current pricing is displayed inside the App and may vary by country, promotion, and Apple's territorial pricing tiers. The price you see at purchase is the price you pay.

Billing

Subscriptions are billed in advance on a recurring weekly basis
Payment is charged to your Apple ID upon confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price
The lifetime purchase is a one-time charge with no renewal

Free Trial

New Oscillia Pro weekly subscribers may be eligible for a 3-day free trial
You will not be charged during the trial period
If you do not cancel before the trial ends, your weekly subscription will automatically begin and you will be charged at the then-current rate
Any unused portion of a free trial is forfeited when you purchase a subscription directly

Cancellation

You can cancel your subscription at any time in the App Store: Settings → [your name] → Subscriptions → Oscillia
Cancellation takes effect at the end of the current billing period; you retain Pro access until that date
Deleting the App does not cancel your subscription
No refunds are provided for partial subscription periods. Refund requests for completed charges must be made to Apple

5. Premium Benefits

Oscillia Pro subscribers and lifetime purchasers receive:

All 27 binaural presets (including the Solfeggio collection)
All 16 bundled ambient sounds and 3 procedural noise generators
6-layer ambient mixer with per-layer volume
Custom preset builder with full frequency, carrier, tone-type, ambient, and duration control
Frequency Explorer with 60-second band sampling
Advanced stats and full unlimited session history
Long sleep timers up to 8 hours for overnight sessions

6. User Obligations

When using the App, you agree to:

Use the App only for lawful purposes
Use the App at safe listening volumes — prolonged exposure to loud audio can damage your hearing
Not use the App while operating a vehicle or heavy machinery
Respect the intellectual property rights of others
Not attempt to gain unauthorized access to any part of the App or our systems

7. Prohibited Activities

You must not:

Attempt to circumvent subscription entitlements, trial eligibility, or free tier gating
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App (except to the limited extent such restriction is prohibited by applicable law)
Modify, adapt, or create derivative works of the App
Use automated systems to access the App or its services
Redistribute, resell, sublicense, or republish the App or its content (including the preset library, ambient audio, or visual design)
Remove any copyright, trademark, or proprietary notices from the App
Use the App to create content that is illegal, harmful, threatening, abusive, or otherwise objectionable

8. Intellectual Property

The App, its original content, preset library, ambient audio assets, visual design (including the generative orb visualizer and shaders), source code, and "Oscillia" name and logo are owned by UKGADGETS LTD and are protected by international copyright, trademark, and other intellectual property laws.

Your licence to use the App is personal, non-exclusive, non-transferable, and revocable, and is granted solely for your own non-commercial use.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF RESULTS, INCLUDING ANY CLAIMED PHYSIOLOGICAL OR PSYCHOLOGICAL EFFECTS OF BINAURAL BEATS OR SOLFEGGIO FREQUENCIES

We do not warrant that the App will be uninterrupted, secure, or error-free, or that it will produce any specific outcome (such as improved sleep, focus, or relaxation).

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UKGADGETS LTD SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, goodwill, or other intangible losses
Any damages arising from your use or inability to use the App
Any health, medical, or psychological outcomes associated with using the App

In no event shall our total liability exceed the greater of (a) the amount you paid for the App in the twelve (12) months preceding the claim, or (b) GBP 50.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

Breach of these Terms
Fraudulent or illegal activity
Attempts to circumvent subscription gating or abuse trial eligibility

Upon termination, your right to use the App will cease immediately. Sections 8 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), and 12 (Governing Law) survive termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. App Store Compliance

The App is made available through the Apple App Store. By using the App, you also agree to comply with the Apple Media Services Terms and Conditions and Apple's App Store Terms of Service.

Apple is not a party to these Terms and is not responsible for the App or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. In the event of any conflict between these Terms and Apple's terms regarding the App, Apple's terms shall prevail solely to the extent of the conflict.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

Updating the "Last updated" date at the top of this page
Posting notice in the App for material changes

Your continued use of the App after changes constitutes acceptance of the new Terms.
